THYMOS — Terms of Use

1. Parties

These Terms of Use and end-user license terms apply between the person using the THYMOS application ("User") and Atakan ER ("Developer"). If you downloaded THYMOS from the Apple App Store, these terms are between the User and the Developer only, not Apple Inc. or any Apple subsidiary. The Developer, not Apple, is solely responsible for THYMOS, its content, support, and services, subject to these Terms.

For App Store downloads, these Terms are not intended to conflict with the Apple Media Services Terms and Conditions, including the App Store Usage Rules. If any App Store-specific rule applies mandatorily, that rule controls to the extent required.

2. Service Description

THYMOS is a digital workout tracking application that offers features such as training log recording, statistics display, data import/export, template and program management, and optional cloud synchronization.

3. Medical Disclaimer

THYMOS is not a medical device. It does not diagnose, recommend treatment, replace a doctor, physiotherapist, dietitian, or personal trainer, and does not guarantee suitability for your health condition.

Please consult a qualified healthcare professional before starting any exercise program or deriving health decisions from app outputs.

4. Account and Synchronization

THYMOS core features can be used offline without creating an account. Some features such as cloud synchronization may optionally require account linking.

The User is responsible for:

providing accurate and current information during account linking,
protecting access credentials for their account,
synchronization usage across their own devices.

The Developer may restrict account linking and synchronization features for security, abuse prevention, or legal compliance reasons.

5. User Obligations

The User agrees not to:

use the application for unlawful purposes,
perform actions that would damage, disrupt, or constitute reverse engineering of the service,
upload content that violates third-party rights,
create misleading, malicious, or automated transaction traffic.

6. Content and Data Responsibility

The User is responsible for the accuracy and consequences of data entered into the application. The Developer does not guarantee the accuracy of user-entered data, notes, programs, or imported file content.

The User also assumes responsibility for regular data export or backup. The Developer exercises reasonable care but does not promise absolute data loss prevention.

7. License and Intellectual Property

Rights relating to the THYMOS application, its design, trademarks, text, visuals, software components, and all related intellectual property belong to Atakan ER or the relevant licensors.

Subject to your compliance with these Terms, the Developer grants you a personal, limited, non-exclusive, non-transferable license to install and use THYMOS for your own lawful, non-commercial use. For the Apple App Store version, this license is limited to use on Apple-branded products that you own or control, and as permitted by the App Store Usage Rules, including Family Sharing or volume purchasing rules where applicable.

These Terms do not transfer ownership of THYMOS or its content. Unauthorized reproduction, distribution, sublicensing, commercial use, reverse engineering, or creation of derivative works is prohibited, except where mandatory law does not allow such restriction.

8. Paid Features

THYMOS may offer paid access under the name THYMOS Pro or a similar plan name. Paid access may be offered as a monthly or yearly auto-renewing subscription and/or as a one-time lifetime purchase, depending on platform, region, release version, and available store offers.

Paid features may include, where available:

unlimited custom exercises and custom templates beyond the free limits,
full progressive program catalog access, custom program builder, program scheduling, auto-distribution, rescheduling, and full use of generated onboarding programs,
smart training features such as RPE/stall/weight nudges, science-based warm-up generation, smart exercise substitutions, detraining alerts, and personalized training tips,
advanced analytics such as full PR history, PR charts and context, full trend history and custom ranges, unlimited trend favorites, advanced trend metrics, filters and settings, longer body heatmap history, set-type analytics, training focus detection, and total-system-weight factor overrides,
unlimited repeat data imports after the free first import,
optional cloud sync, manual or automatic sync, multi-device availability, and cloud backup,
saved plate inventories and other power-user customization features,
future Pro-only or optional paid features clearly shown before purchase.

The free version remains usable as an offline-first workout logbook. Core workout logging, access to your local workout history, deletion controls, privacy/legal screens, billing controls, and full CSV/JSON export are not intended to be locked solely because a subscription ends.

The exact price, currency, taxes, trial duration, renewal period, included features, and any introductory or lifetime offer are shown before purchase in the relevant app store purchase flow. Auto-renewing subscriptions renew until cancelled. You can cancel an App Store subscription through your Apple account settings; cancellation must generally be completed at least 24 hours before the end of the current period to avoid renewal. Refund requests are handled by the app store where the purchase was made and are subject to that store's policies.

9. Third-Party Terms

The User must comply with applicable third-party terms when using THYMOS, including app store terms, operating system terms, device terms, and any optional cloud or payment provider terms that apply to features the User chooses to use.

10. Service Continuity and Right to Change

The Developer may:

update application features,
temporarily or permanently change certain features,
interrupt service for maintenance, security, or technical necessity,
suspend certain functions for legal or operational reasons.

11. Maintenance and Support

The Developer is responsible for providing maintenance and support for THYMOS as described in these Terms or as required by applicable mandatory law. For the Apple App Store version, Apple has no obligation to provide maintenance or support services for THYMOS.

12. Warranty and Limitation of Liability

To the fullest extent permitted by applicable mandatory law:

THYMOS is provided "as is",
no guarantee of uninterrupted, error-free, or fitness-for-purpose operation is given,
the Developer's liability for indirect damages, data loss, lost profits, or training outcome expectations is limited.

This provision does not eliminate your rights arising from mandatory consumer legislation or cases of intent or gross negligence.

For the Apple App Store version, if THYMOS fails to conform to any applicable warranty that cannot be disclaimed, the User may notify Apple, and Apple will refund the purchase price for THYMOS, if any, in accordance with Apple's applicable policies. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to THYMOS. Any other claims, losses, liabilities, damages, costs, or expenses attributable to a warranty failure are the Developer's responsibility to the extent required by law.

13. Product Claims and Intellectual Property Claims

The Developer, not Apple, is responsible for addressing claims by the User or any third party relating to THYMOS or the User's possession and use of THYMOS, including product liability claims, legal or regulatory non-conformance claims, and claims under consumer protection, privacy, or similar legislation.

If a third party claims that THYMOS or the User's possession and use of THYMOS infringes that third party's intellectual property rights, the Developer, not Apple, is responsible for the investigation, defense, settlement, and discharge of that intellectual property infringement claim to the extent required by these Terms and applicable law.

14. Legal Compliance

The User represents and warrants that they are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and that they are not listed on any U.S. Government list of prohibited or restricted parties. The User is responsible for complying with applicable export control, sanctions, and local laws when using THYMOS.

15. Privacy and Personal Data

The principles regarding the processing of personal data are explained separately in the THYMOS KVKK Aydınlatma Metni and Privacy Policy. Separate consent may be obtained for processing that requires explicit consent.

16. Account or Access Termination

The User may stop using the application and request account closure/data deletion via the in-app account deletion flow (Settings > Sync > Delete Account) or via hello@thymos.fit. When the account is deleted, all synchronization data on the server is permanently deleted; local data on the device is not affected.

The Developer may suspend a User's access to certain features in cases of abuse, illegality, security breach, or technical necessity.

17. Governing Law and Jurisdiction

These Terms of Use are governed by the laws of the Republic of Türkiye and Ankara Courts have jurisdiction. Mandatory jurisdiction rules arising from consumer legislation are reserved.

18. Apple as Third-Party Beneficiary

For the Apple App Store version of THYMOS, Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Upon the User's acceptance of these Terms, Apple has the right, and will be deemed to have accepted the right, to enforce these Terms against the User as a third-party beneficiary.

1. Taraflar

İşbu Kullanım Koşulları ve son kullanıcı lisans hükümleri, THYMOS uygulamasını kullanan kişi ("Kullanıcı") ile Atakan ER ("Geliştirici") arasında uygulanır. THYMOS'u Apple App Store üzerinden indirdiyseniz, bu hükümler yalnızca Kullanıcı ile Geliştirici arasında geçerlidir; Apple Inc. veya Apple'ın bağlı şirketleri taraf değildir. THYMOS'tan, içeriğinden, desteğinden ve hizmetlerinden bu Koşullar kapsamında Apple değil Geliştirici sorumludur.

App Store üzerinden indirilen sürüm bakımından bu Koşullar, App Store Usage Rules dahil olmak üzere Apple Media Services Terms and Conditions ile çelişmeyi amaçlamaz. Zorunlu olarak uygulanan bir App Store kuralı varsa, gerekli olduğu ölçüde ilgili Apple kuralı geçerli olur.

2. Hizmetin Konusu

THYMOS; antrenman kayıtlarının tutulması, istatistiklerin görüntülenmesi, veri içe aktarma/dışa aktarma, şablon/program yönetimi ve isteğe bağlı bulut senkronizasyonu gibi işlevler sunan bir dijital egzersiz takip uygulamasıdır.

3. Tıbbi Uyarı

THYMOS bir tıbbi cihaz değildir. Teşhis koymaz, tedavi önermez, doktor, fizyoterapist, diyetisyen veya kişisel antrenör yerine geçmez, sağlık durumunuza uygunluk garantisi vermez.

Herhangi bir egzersiz programına başlamadan veya uygulama çıktılarından sağlık kararı türetmeden önce uygun bir sağlık uzmanına danışmanız tavsiye edilir.

4. Hesap ve Senkronizasyon

THYMOS'un temel işlevleri hesap oluşturmadan ve çevrimdışı kullanılabilir. Bulut senkronizasyonu gibi bazı özellikler isteğe bağlı olarak hesap bağlama gerektirebilir.

Kullanıcı:

hesap bağlama sırasında doğru ve güncel bilgi vermekten,
hesabına ilişkin erişim araçlarını korumaktan,
kendi cihazları arasındaki senkronizasyon kullanımından

sorumludur.

Geliştirici, güvenlik, kötüye kullanımın önlenmesi veya hukuki yükümlülükler nedeniyle hesap bağlantısı ve senkronizasyon özelliklerinde sınırlama yapabilir.

5. Kullanıcının Yükümlülükleri

Kullanıcı, uygulamayı:

hukuka aykırı amaçlarla kullanmamayı,
hizmete zarar verecek, kesintiye uğratacak veya tersine mühendislik teşkil edecek işlemler yapmamayı,
üçüncü kişilerin haklarını ihlal edecek içerik yüklememeyi,
yanıltıcı, kötü niyetli veya otomatikleştirilmiş işlem trafiği oluşturmamayı

kabul eder.

6. İçerik ve Veri Sorumluluğu

Kullanıcı, uygulamaya girdiği verilerin doğruluğundan ve sonuçlarından kendisi sorumludur. Geliştirici, kullanıcı tarafından girilen veri, not, program veya içe aktarılan dosya içeriğinin doğruluğunu garanti etmez.

Kullanıcı, düzenli olarak dışa aktarım veya yedek alma sorumluluğunu da üstlenir. Geliştirici, makul özen göstermekle birlikte mutlak veri kayıpsızlığı taahhüdü vermez.

7. Lisans ve Fikri Mülkiyet

THYMOS uygulamasına, tasarımına, markalarına, metinlerine, görsellerine, yazılım bileşenlerine ve ilgili tüm fikri mülkiyet haklarına ilişkin haklar Atakan ER veya ilgili lisans verenlerine aittir.

Bu Koşullara uymanız şartıyla Geliştirici size THYMOS'u kendi hukuka uygun, ticari olmayan kişisel kullanımınız için kurma ve kullanma konusunda kişisel, sınırlı, münhasır olmayan ve devredilemez bir lisans verir. Apple App Store sürümü bakımından bu lisans, sahip olduğunuz veya kontrol ettiğiniz Apple markalı ürünlerde ve varsa Family Sharing veya toplu satın alma kuralları dahil App Store Usage Rules tarafından izin verilen şekilde kullanım ile sınırlıdır.

Bu Koşullar, THYMOS'un veya içeriğinin mülkiyetini devretmez. Zorunlu mevzuatın aksine izin verdiği durumlar saklı kalmak üzere uygulamanın izinsiz çoğaltılması, dağıtılması, alt lisanslanması, ticari kullanımı, tersine mühendisliği veya türev eser oluşturulması yasaktır.

8. Ücretli Özellikler

THYMOS, THYMOS Pro veya benzer bir plan adı altında ücretli erişim sunabilir. Ücretli erişim; platforma, bölgeye, yayın sürümüne ve mağaza tekliflerine bağlı olarak aylık veya yıllık otomatik yenilenen abonelik ve/veya tek seferlik ömür boyu satın alma şeklinde sunulabilir.

Ücretli özellikler, mevcut oldukları ölçüde şunları içerebilir:

ücretsiz limitlerin üzerinde sınırsız özel egzersiz ve özel şablon,
tam progresif program kataloğu, özel program oluşturucu, program planlama, otomatik dağıtım, yeniden planlama ve onboarding sırasında oluşturulan programların tam kullanımı,
RPE/stall/ağırlık önerileri, bilimsel ısınma oluşturma, akıllı egzersiz alternatifi önerileri, detraining uyarıları ve kişiselleştirilmiş antrenman ipuçları gibi akıllı antrenman özellikleri,
tam PR geçmişi, PR grafikleri ve bağlamı, tam trend geçmişi ve özel tarih aralıkları, sınırsız trend favorisi, gelişmiş trend metrikleri, filtreleri ve ayarları, daha uzun kas haritası geçmişi, set tipi analitiği, antrenman odağı tespiti ve total-system-weight faktör ayarları gibi gelişmiş analitik özellikleri,
ücretsiz ilk içe aktarımdan sonra sınırsız tekrar veri içe aktarımı,
isteğe bağlı bulut senkronizasyonu, manuel veya otomatik senkronizasyon, çoklu cihaz kullanımı ve bulut yedekleme,
kaydedilmiş plaka envanterleri ve power-user kişiselleştirme özellikleri,
satın alma öncesinde açıkça gösterilecek gelecekteki Pro veya opsiyonel ücretli özellikler.

Ücretsiz sürüm, offline-first bir antrenman günlüğü olarak kullanılabilir kalır. Temel antrenman kaydı, yerel antrenman geçmişinize erişim, silme kontrolleri, gizlilik/yasal ekranlar, faturalandırma kontrolleri ve tam CSV/JSON dışa aktarım özelliklerinin yalnızca abonelik sona erdiği için kilitlenmesi amaçlanmaz.

Kesin fiyat, para birimi, vergiler, deneme süresi, yenileme dönemi, dahil olan özellikler ve varsa başlangıç veya ömür boyu teklif, ilgili uygulama mağazasındaki satın alma akışında satın alma öncesinde gösterilir. Otomatik yenilenen abonelikler iptal edilene kadar yenilenir. App Store aboneliğinizi Apple hesap ayarlarınızdan iptal edebilirsiniz; yenilemeyi önlemek için iptalin genellikle mevcut dönemin bitiminden en az 24 saat önce tamamlanması gerekir. İade talepleri satın almanın yapıldığı uygulama mağazası tarafından ve ilgili mağazanın politikalarına göre yürütülür.

9. Üçüncü Taraf Koşulları

Kullanıcı, THYMOS'u kullanırken ilgili üçüncü taraf koşullarına uymakla yükümlüdür. Buna uygulama mağazası koşulları, işletim sistemi koşulları, cihaz koşulları ve Kullanıcının tercih ettiği özelliklere uygulanabilecek isteğe bağlı bulut veya ödeme sağlayıcısı koşulları dahildir.

10. Hizmet Sürekliliği ve Değişiklik Hakkı

Geliştirici:

uygulama özelliklerini güncelleyebilir,
bazı özellikleri geçici veya kalıcı olarak değiştirebilir,
bakım, güvenlik veya teknik zorunluluk nedeniyle hizmette kesinti yapabilir,
hukuki veya operasyonel nedenlerle belirli işlevleri askıya alabilir.

11. Bakım ve Destek

THYMOS bakım ve destek hizmetlerinin bu Koşullarda açıklandığı veya zorunlu mevzuatın gerektirdiği ölçüde sağlanmasından Geliştirici sorumludur. Apple App Store sürümü bakımından Apple'ın THYMOS için bakım veya destek hizmeti sağlama yükümlülüğü yoktur.

12. Garanti ve Sorumluluğun Sınırlandırılması

Yürürlükteki zorunlu mevzuatın izin verdiği en geniş ölçüde:

THYMOS "olduğu gibi" sunulur,
kesintisiz, hatasız veya belirli bir sonuca uygun çalışma garantisi verilmez,
dolaylı zararlar, veri kaybı, kazanç kaybı veya antrenman sonuçlarına ilişkin beklentiler bakımından Geliştirici sorumluluğu sınırlıdır.

Bu hüküm, kast veya ağır ihmal halleri ile zorunlu tüketici mevzuatından doğan haklarınızı ortadan kaldırmaz.

Apple App Store sürümü bakımından, THYMOS feragat edilemeyen uygulanabilir bir garantiye uygun değilse Kullanıcı Apple'a bildirimde bulunabilir ve Apple, varsa THYMOS için ödenen satın alma bedelini Apple'ın geçerli politikalarına uygun olarak iade eder. Kanunen izin verilen azami ölçüde Apple'ın THYMOS bakımından başka bir garanti yükümlülüğü yoktur. Garantiye aykırılıktan kaynaklanan diğer talep, kayıp, sorumluluk, zarar, masraf veya giderlerden kanunen gerekli olduğu ölçüde Geliştirici sorumludur.

13. Ürün Talepleri ve Fikri Mülkiyet Talepleri

THYMOS'a veya Kullanıcının THYMOS'a sahip olması ve kullanmasına ilişkin Kullanıcı ya da üçüncü taraf taleplerini ele almaktan Apple değil Geliştirici sorumludur. Buna ürün sorumluluğu talepleri, hukuki veya regülasyonlara aykırılık iddiaları, tüketici koruma, gizlilik veya benzeri mevzuat kapsamındaki talepler dahildir.

Bir üçüncü taraf THYMOS'un veya Kullanıcının THYMOS'a sahip olması ve kullanmasının üçüncü tarafın fikri mülkiyet haklarını ihlal ettiğini iddia ederse, bu fikri mülkiyet ihlali iddiasının araştırılması, savunulması, uzlaştırılması ve giderilmesinden bu Koşullar ve yürürlükteki hukuk kapsamında Apple değil Geliştirici sorumludur.

14. Hukuki Uyum

Kullanıcı, ABD Hükümeti ambargosuna tabi bir ülkede veya ABD Hükümeti tarafından "terörü destekleyen" ülke olarak tanımlanmış bir ülkede bulunmadığını ve ABD Hükümeti'nin yasaklı veya kısıtlı taraflar listesinde yer almadığını beyan ve taahhüt eder. Kullanıcı, THYMOS'u kullanırken geçerli ihracat kontrolü, yaptırım ve yerel mevzuata uymaktan sorumludur.

15. Gizlilik ve Kişisel Veriler

Kişisel verilerin işlenmesine ilişkin esaslar, THYMOS KVKK Aydınlatma Metni ve Privacy Policy içinde ayrıca açıklanır. Açık rıza gerektiren işlemler bakımından ayrıca onay alınabilir.

16. Hesabın veya Erişimin Sonlandırılması

Kullanıcı, uygulamayı kullanmayı bırakabilir ve hesabının kapatılmasını/verilerinin silinmesini uygulama içi hesap silme akışı (Ayarlar > Sync > Hesabı Sil) veya hello@thymos.fit üzerinden talep edebilir. Hesap silindiğinde sunucudaki tüm senkronizasyon verileri kalıcı olarak silinir; cihaz üzerindeki yerel veriler etkilenmez.

Geliştirici; kötüye kullanım, hukuka aykırılık, güvenlik ihlali veya teknik zorunluluk halinde kullanıcının belirli özelliklere erişimini askıya alabilir.

17. Uygulanacak Hukuk ve Yetki

İşbu Kullanım Koşulları Türkiye Cumhuriyeti hukukuna tabidir ve Ankara Mahkemeleri yetkilidir. Uyuşmazlıklarda, tüketici mevzuatından doğan zorunlu yetki kuralları saklıdır.

18. Apple'ın Üçüncü Taraf Lehtar Sıfatı

THYMOS'un Apple App Store sürümü bakımından Apple ve Apple'ın bağlı şirketleri bu Koşulların üçüncü taraf lehtarlarıdır. Kullanıcının bu Koşulları kabul etmesiyle Apple, bu Koşulları Kullanıcıya karşı üçüncü taraf lehtar olarak ileri sürme hakkına sahip olur ve bu hakkı kabul etmiş sayılır.
